What Is Probate?

Probate is the court-supervised process of distributing a decedent’s assets (the “estate”) to the rightful beneficiaries. This process is required when some or all of the decedent’s assets are not already distributed through another mechanism.

During probate, the court appoints a person to manage the estate known as an "executor" if the decedent left a will, or an "administrator" if they did not. The court also requires that notice be given to the decedent’s family members, heirs, and creditors to ensure all parties are informed of the estate proceedings.

What Assets Avoid Probate?

Not every person that passes away requires a probate. A probate is not necessary for the following types of assets:
  • Accounts With a Named Beneficiary: These accounts, often called pay-on-death (POD) or transfer-on-death (TOD) accounts, can be transferred to the designated beneficiary simply by providing a death certificate and identification.
  • Assets held in joint tenancy with right of survivorship: When an owner of a joint account passes away, the surviving joint owner(s) automatically retain ownership. A death certificate is required to remove the deceased owner, though in some cases, such as when a joint owner was added for convenience, survivors may not inherit the account.
  • Assets held in Trust: Holding assets in a trust is one of the most effective ways to avoid probate. The trustee distributes these assets according to the terms of the trust.
  • ​Assets intended to be held in Trust: Sometimes a decedent had a trust but did not transfer certain assets into it. In some situations, these assets can be moved into the trust after death.
  • Assets with a value under $184,500 – Non-real estate assets valued below $184,500 can often pass to heirs without formal probate, using a simplified summary proceeding or affidavit process.

The Probate Process

The probate process can feel complex, but understanding the basic steps can help ease the burden. Below is an overview of how estates are typically administered through probate:
  • Filing the Petition: The probate process begins by filing a petition with the Probate Court to open the estate.
  • Appointment of Executor or Administrator: The court officially appoints the person responsible for managing the estate.
  • Notifying Heirs and Creditors: Family members, heirs, and creditors are formally notified of the probate proceedings.
  • ​Inventory and Appraisal of Assets: All estate assets are identified, valued, and documented for the court.
  • Paying Debts and Taxes: Outstanding debts, taxes, and administrative expenses are paid from the estate.
  • ​Resolving Disputes: Any challenges to the will or claims against the estate are addressed during probate.
  • ​Distribution of Assets: Remaining assets are distributed to beneficiaries according to the will or, if no will exists, state law.
  • ​Closing the Estate: Once all assets are distributed and obligations satisfied, the court formally closes the estate.
